CALL TO ORDER
The meeting was called to order at 7:04 p.m.
ROLL CALL
Present were Supervisors Naomi Decker and Larry Lambert, Dominick Picarelli, Planner Tina Fackler, Secretary Nancy Zentmeyer. Visitors included: Rodney Decker and Wayne Kober.
ORDER OF BUSINESS
Tina Fackler presented a handout on The Zoning Hearing Board from DCED which is a requirement of the Zoning Ordinance for hardship cases. It was noted that the Zoning Hearing Board is a quasi-judicial body. The handout explains the functions of the Board and the procedures.
There was discussion on Special Exceptions such as is this use good for the Township, and a Special Exception is needed before a subdivision/land development plan can be submitted. The applicant would submit an application to the ZHB, a hearing would be scheduled, the Board would hear the testimony and a written decision would then be submitted to the Township before the submission of a plan which would still need to be consistent with the ordinances. It was noted that the Planning Commission and Board of Supervisors do have the final say on any plan.
A separate Solicitor would be needed for the ZHB. All information submitted to the Township would be on file at the Township office and public to the residents. The Zoning Officer can make a judgment call to enforce the ordinance and if the property owner disagrees than they can go before the ZHB.
Larry Lambert asked if Special Exceptions could go into permitted uses. Tina Fackler noted that Special Exceptions and Conditional Uses that would be impacting the community is when the ZHB comes into effect, that they would be an extra body to help determine use or type of use.
There was discussion on the infrastructure/roadways and to prove it can fit in that location or zone.
Naomi Decker questioned moving the Conditional Uses to the Board of Supervisors. It was noted that a Conditional Use must go through the hearing process.
Other issues that would go before the ZHB is a zoning change and change of zoning ordinance. It was noted that the Township can appeal a decision.
Also discussed is that the Township would have to establish a standard fee schedule, which should include administrative costs, advertisements, and fee for the ZHB Solicitor. It was noted that this could be done by a Resolution. It was noted that the ZHB could have either three or five member board.
Naomi Decker stated that she does not want to see the mountain area disturbed and this was addressed in the Comprehensive Plan. High Density is currently on the zoning map in other areas and does not want to see the mountain area developed as High Density.
Other items of concern are the steep slope areas, conservation, and floodplain and Dominick Picarelli stated that there will be overlays of these areas. It was noted that if there is public sewer and water this would be the location for High Density. There is criteria that the Board of Supervisors need to review.
It was noted that the Industrial District was discussed at the last meeting and Tina Fackler indicated that Mixed Use District will be discussed tonight. The MU District is less residential and more of a variety of commercial, personal services, and non-impacted uses.
Larry Lambert noted that in the Conservation (C) District B1 "Agricultural, horticultural and forestry-related uses should be in MU District
In MU District the following under Permitted Uses (B) were discussed:
#1, through 11 should remain
#12 omit excluding drive-through and fast food
#13 the square footage should be increased to 10,000 s.f.
#14 and 15 should remain
#16 could indicate various accessory uses and should be a Conditional Use
In MU District the following under Special Exception Uses (C) were discussed:
# 1, 4, 6, 7 should be included in permitted uses
In MU District the following under Minimum Lot Area Requirements (D) were discussed:
they should stay the same and it was indicated that 20,000 s.f. is just a little less than an half acre
In MU District the following under Lot Dimension Requirements (E) were discussed:
#1 should indicate along roadway
#2 and 3 should remain
#4 had discussion with parking in the rear setback
#5 and 6 should remain
In Section XXX – Performance Standards #10 e. and f. were discussed. These should remain as they are for security requirements. #10 e. was discussed in regards to glare or direct illumination and what problems could arise with adjoining property owners.
In MU District the following under Maximum Permitted Building Height (F) were discussed:
- #1 should remain
#2 should be omitted
#3 should remain
In MU District the following under Site Requirements (G) were discussed:
#1 through 4 are to remain
There was discussion on businesses with equipment running outside beside a residential area and no type of screening or buffering. It was suggested that sound barriers may be the answer.
In the MU District under Access drives, stormwater management plans, and parking lots (H) this should remain with no changes.
In MU District under Agricultural Nuisance Disclaimer (I) it should be revised under the Right to Farm Act which is more current than 1982, for the latest revisions.
It was suggested that when there is an update to any of the districts, tables, maps or administrative sections that a revision date be placed on the document so everyone knows which document is being reviewed.
It was noted that on steep slopes between 15% and 25% a building can be constructed.
In the Residential District there was discussion on the minimum lot area requirements and it was noted that with the minimum lot size being 10,000 s.f. this should be considered high density, but also noting the #1-3 should remain.
In the Conservation District which is established in the Township under an ordinance is noted that 4-acres is the minimum and there should be consideration between 2 and 4 acres. This would depend on the design of the land, open space, etc.
Tina Fackler asked that the Supervisors review the handouts and write down any questions or concerns so they can be addressed at the next meeting.
It was noted that the next two meetings will be held on June 9th and 30th beginning at 7 p.m.
